This ‘Terms & Conditions’ document govern how User uses the content and services provided by RAGHASASTRO (herein referred to as ‘Website’, ‘www.raghasastro.com’, ‘Company’, ‘App’, Platform, ‘We’, ‘Ours’, ‘Us’,). The term (‘User’, ’You’) are intended towards those who access or utilize our services. Please carefully read the below document to remain in compliance with the terms.

CHANGES & USER CONSENT

Users are informed that this document is subject to changes as deemed necessary by the company and there would be an update/amendment from time to time. If amendment is done after User registers with the site, it automatically applies to him. Continued usage of Platform implies User agrees to accept the terms and conditions. By clicking on ‘Agree’ consent on our app or Website, you agree to abide by the terms and conditions given here. If not, then please do not use this Website. Users registered with the Website, consents, and agrees to Privacy Policy which is to be read and understood along with this document.

WHO ARE WE?

RAGHASASTRO is an educational platform available in the mode of Website, android mobile app and iOS mobile app. We provide electronic medium for a User to learn about astrology in the form of courses and use our software to do predictions.

ELIGIBILITY

Individuals who can form legally binding contracts under applicable law are eligible for the Services provided by us. The Website does not permit services for Users who are resident of a state/country which prohibits by law trade relationships. The Website does not permit services for Users who are restricted by religious practice.

Under Indian Contract Act 1872, a minor under the age of 18 is restricted and prohibited from accessing any contents on the Website. Even though we do not have contents that are harmful for children, we will not be responsible for any misuse by children.

REGISTRATION

A User registers on the Website with his mobile number. Registered User has access to all paid contents and agree to provide accurate, complete, and updated information regarding him. This helps Website to provide appropriate services to the Users.

While entering mobile number, you agree to share the same with the platform and our service providers and validating your account using OTP, User agrees to provide accurate and updated information. Posing as someone else and using others account is not permitted. If in case it is found, the Website has the right to terminate the account. The User would be fully responsible for all the activities in their account, and the Website is not liable for any loss or damage arising from the User’s failure to maintain secrecy and confidentiality. The User shall notify the Website immediately if they become aware of any unauthorized use of their account or breach of any security. Users are advised to use ‘Log Out’ feature for better safety.

DATA ON OUR WEBSITE

• The Website reserves the right to change, suspend, or discontinue any service, feature, or content at its sole discretion.
• Members/Users should not rely on or make any legal, health, finance or other important decisions based on the guidance provided by an Astrologer. Do consult a qualified professional for guidance related to medical or mental health. Any opinion, advice, guidance, prediction, information, and services provided by our Users to others are to be regarded as entertainment info.
• The consultations based on the software are meant as pure suggestions and not to be taken as advice, platform does not guarantee results.
• If User’s mobile number is on ‘DND [Do not disturb]’ with a service provider, and he has registered with the Website, the Website reserves the right to call for marketing or feedback. The User’s also can disagree while logging in to not be contacted for marketing. If User agrees, then he will receive communication through notification system in the app/Website, also through email/SMS or any other communication medium including through WhatsApp Business messages pertaining to the usage of the app/Website and promotional advertisements.
• By using the Site, Application or Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Members, inclusive of the service provider registered with the Website or other third parties linked with the Website, shall be limited to claim against such party who may have caused any harm. You understand that the Website is not responsible for such actions and omissions and any liability or legal remedy sought on this is considered invalid.
• Users shall not commercially exploit, resell, reproduce, or distribute any Website content, software, or information without prior written consent from RAGHASASTRO.
• Users are not permitted to decrypt, decompile, reverse engineer, extract source code, or derive any data associated with the Website or Application. Any attempt to do so may result in termination of account and legal action under applicable laws including the Information Technology Act, 2000.
• The User is under an obligation to report any misuse of the site. Any false complaint made by a User shall make such User liable for termination of his account with the Website.
• Permission is granted to temporarily access and use the materials, software, and information available on the Website strictly for personal and non-commercial use only. Any unauthorized commercial use, redistribution, mirroring, or copying of Website content is prohibited.

TERMINATION

• Violations of any conditions mentioned will lead to termination of account of the User.
• The User account will be terminated, if the User registration information is non verifiable or not authenticate.
• The User account will be terminated, if any action of User causes legal issues for the Website.
• Violation of Privacy policy or User interfering with Website administration activities will result in termination.

LIMITATION OF LIABILITY

• In no event shall RAGHASASTRO, its owners, employees, affiliates, service providers, licensors, or partners be liable for any indirect, incidental, consequential, special, punitive, or business-related damages arising from:
• Use or inability to use the Website or Application;
• Loss of profits, data, goodwill, or reputation;
• Service interruptions;
• Technical failures;
• Unauthorized access;
• Third-party actions.
• Users access and use the Website entirely at their own discretion and risk.

REFUND & CANCELLATION

• Cancellation or refund requests for course purchases may be submitted within 3 days from the date of purchase. The reason for cancellation must be genuine and will be reviewed at the sole discretion of the RaghasAstro Team.
• Refund requests may be declined if the reason provided is found to be invalid, misleading, or if there is evidence that the course content has already been substantially accessed or consumed.
• All refund requests are subject to internal review and audit by our team. The verification and processing of refunds may take up to 7 business days. The final credit timeline may additionally depend on the processing time of the respective bank and/or payment gateway. International refunds may take up to 35 days to reflect.
• Approved refunds, if any, will be processed after deduction of applicable transaction charges, payment gateway fees, banking charges, taxes, or any other service-related costs incurred during the transaction process.

FORCE MAJEURE

Neither the Company nor the App shall be liable for damages for any delay or failure to perform its obligations hereunder if such delay or failure is due to cause beyond its control or without its fault or negligence, due to Force Majeure events including but not limited to acts of war, acts of God, terrorism, earthquake, flood, strike, riot, fire, explosion, festive activities sabotage, labour shortage or dispute, internet interruption, technical failure, breakage of sea cable, hacking, piracy, cheating, illegal or unauthorized acts, riot or other civil commotion, failure in transportation, act of any government or any court or administrative agency thereof, epidemics or quarantine restrictions, or other cause(s) beyond the reasonable control of Us (“Force Majeure”). Upon cessation of the cause of the Force Majeure, the Terms explained here, shall again become fully operative.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless RaghasAstroand its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from Your use of the Services, Your violation of the Privacy Policy or these Terms of Service, or Your violation of any third party’s rights, including without limitation, infringement by You or any other User of Your account of any intellectual property or other right of any person or entity. Users are not permitted to use the website or application to send any automated queries or unsolicited mails to any other websites, and the user must not alter any proprietary notices. These Terms of Service will inure to the benefit of RAGHASASTRO’s successors, assigns, and licensees.

PROPRIETARY RIGHTS TO CONTENT

You acknowledge that the Content, including but not limited to text, software, music, sound, photographs, video, graphics, or other material contained in either sponsor advertisements or distributed via email, commercially produced information presented to Member by RAGHASASTRO, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. You are not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by RAGHASASTRO, its suppliers, or advertisers.

NOTICE

Except as otherwise stated in these Terms of Service, all notices to a party shall be in writing and shall be made either via email or snail mail. Notice shall be deemed given 24 hours after an email is sent, or 3 days after deposit in the snail mail, to Member at the address provided by Member in the Registration Data and to RAGHASASTRO at the address set forth below:

RESTRICTED CONTENT

Child Abuse: Any kind of action categorized under child abuse or exploitation is prohibited on this Website. Appropriate action will be taken, and law enforcement authorities will be notified.

Inappropriate content: The Website is a safe place and does not promote sexual content or profanity, including pornography, or any content or services intended to be sexually gratifying. Accounts of Users sharing or promoting such contents will be terminated and appropriate law actions will be taken against them.

Selling of dangerous product: Our site does not sell dangerous products like firearms, drugs, weapons, tobacco, and alcohol. Users are warned to stay away from such illegal activities.

BlackMagic and other unethical practices: Users are strictly warned against promoting such activities on the Website.

RIGHT TO MODIFY, CORRECT & DISCONTINUE

We cannot warrant that the Website will be error-free, virus free or free of other components, or that defects will be corrected. We strive to get accurate, correct, and timely information on our website but cannot warrant that. If deemed necessary, we will bring about changes to our functionality and contents at any time. We reserve the right in our sole discretion to edit or delete any documents, information, or other contents on the Website. We reserve the right to modify or discontinue. temporarily or permanently, the Services and/or Sites (or any part thereof) with or without notice. RAGHASASTRO is not liable to you or to any third party for any modification, suspension or discontinuance of the Service or any Sites.

GOVERNING LAW AND JURISDICTION

• Any dispute, claim or controversy arising out of or relating to this Terms of Usage including the determination of the scope or applicability of this Terms of Usage to arbitrate, or your use of the Application or information to which it gives access, shall be determined by arbitration in India before a sole arbitrator mutually appointed by Members and Website. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Bengaluru. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.
• Notwithstanding the foregoing, either party has the right to seek any interim or preliminary relief from a court of competent jurisdiction in Bengaluru to protect the rights of such party pending the completion of any arbitration hereunder, and both parties agree to submit to the exclusive jurisdiction of the courts of India and venue in Bengaluru for any such proceeding. If either party files an action contrary to this provision, the other party may recover attorneys’ fees and costs up to One Lakh Rupees INR.
• These Terms of Usage shall be governed by and construed in accordance with the laws of India without giving effect to any choice of law and principles that would require the application of the laws of a different state. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Usage or Privacy Policy to be unenforceable or invalid, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law, and the remainder of the Terms of Usage or Privacy Policy, as applicable, will continue in full force and effect. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Any waiver of any provision of the Terms of Usage shall be effective only if in writing and signed by RAGHASASTRO. These Terms of Usage constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
• These Terms of Usage and your use of the Services will be interpreted in accordance with the laws of India excluding its rules on conflicts of laws. The parties agree to submit any dispute arising under these Terms of Usage to the jurisdiction of a court located in Bengaluru for any actions for which the parties retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
